Throughout the site the terms “we”, “us” and “our” refer to NMV Ventures Private Limited. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing our cookware you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”) including all additional terms, conditions, and policies referenced herein and/or available via hyperlink on our website (including but not limited to our Privacy Policy, Cancellation, Return & Refund Policy, and Warranty Policy). Please read these Terms carefully before accessing or using our website. 

1. Eligibility and Account Security

By agreeing to these Terms of Service you represent that you are at least the age of majority in your state or province of residence. You agree to provide accurate, current, and complete account information for all purchases made at our store. You are entirely responsible for maintaining the confidentiality of your account credentials and password. NMV Ventures Private Limited cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.

2. Pricing, Products, and Display Errors

We strive to ensure all product descriptions and prices are completely accurate on our store. However, typographical errors, system glitches or pricing inaccuracies may rarely occur.

  • Our Protection Clause: In the event that a product is mistakenly listed at an incorrect price or with incorrect structural details NMV Ventures Private Limited reserves the right to refuse or cancel any orders placed for that product.

  • Customer Fairness: If your credit card, debit card, or bank account has already been charged for the purchase and we cancel the order we will issue a 100% full refund to your original payment source immediately.

  • Modifications: Prices for our cookware are subject to change without notice. We reserve the right to modify or discontinue any product line or service at any time.

3. Accuracy of Billing and Payment Gateway Flow

You agree to pay all charges incurred by usage of your credit card, debit card, or other payment method at the prices in effect when such charges are incurred. All payments are processed securely through RBI-authorized third-party payment gateways. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order (for instance, if we suspect an order is placed by a dealer, reseller, or distributor trying to exploit our consumer retail pricing).

4. Intellectual Property Rights

All content included on this website—including but not limited to the Bhumi Indica brand name, logo designs, custom website layouts, graphics, product photographs, lifestyle images, and written product descriptions—is the exclusive intellectual property of NMV Ventures Private Limited.

This content is protected by Indian copyright, trademark, and intellectual property laws. You are strictly prohibited from copying, reproducing, scraping, duplicating, or exploiting any portion of our visual media or text for commercial purposes without receiving explicit written permission from us.

5. User-Generated Content and Reviews

We love seeing our customers cook with our cookware! If you post a review, share photographs, or submit comments on our website you grant NMV Ventures Private Limited a non-exclusive, royalty-free, perpetual and worldwide license to use, reproduce, modify and display that content in our marketing materials, social media feeds or digital advertisements. You agree that your comments will not violate any third-party rights and will not contain unlawful, abusive or defamatory material.

6. Prohibited Uses of the Website

In addition to other prohibitions as set forth in the Terms of Service you are prohibited from using the site or its content:

  • For any unlawful purpose or to solicit others to perform unlawful acts.

  • To violate any international, federal, provincial, or state regulations, rules or local laws.

  • To upload or transmit viruses or any other type of malicious code that will compromise the functionality of our Shopify storefront.

7. Account Suspension and Termination

To maintain a secure shopping environment and ensure fair access to our artisanal inventory for all genuine customers NMV Ventures Private Limited reserves the right to temporarily suspend or permanently terminate your website account or block your access to our store without prior notice.

This operational action will only be exercised under specific circumstances including but not limited to:

  • Abuse of Services: Evidence of serial order cancellations, repetitive doorstep delivery refusals or malicious activity that causes unjust logistics losses to the brand.

  • Fraudulent Activity: Reasonable suspicion of identity theft, unauthorized payment method usage or creating multiple accounts to manipulate consumer promotions or discount structures. 

  • Commercial Reselling: Clear indicators that the account is being used to hoard retail consumer inventory for unauthorized commercial reselling or distribution.

  • Security Breaches: Any attempt to introduce malicious code, scrape data or compromise the technical infrastructure of our website.

If your account is suspended or terminated you remain fully liable for any outstanding financial obligations or processed orders incurred up to the date of termination.

8. Limitation of Liability

In no case shall NMV Ventures Private Limited, our directors, officers, employees or artisans be liable for any injury, loss, claim or any direct, indirect, incidental, punitive or consequential damages of any kind including, without limitation, lost profits or revenue arising from your use of any of our products or services. This includes structural damage or injury resulting from a failure to follow the explicit Usage & Maintenance Guidelines provided with our cookware. Our total cumulative liability to you for any claim arising out of these terms shall not exceed the actual amount paid by you for the specific product under dispute.

9. Governing Law and Legal Jurisdiction

These Terms of Service and any separate agreements whereby we provide you services or products shall be governed by and construed in accordance with the laws of India.

Any legal disputes, claims or proceedings arising directly out of these Terms or your purchase of our cookware shall be subject exclusively to the legal jurisdiction of the competent courts located in Gautam Buddha Nagar, Uttar Pradesh, India.

10. Indemnification

You agree to indemnify, defend and hold harmless NMV Ventures Private Limited, our directors, officers, employees, interns and operational partners from any claim or demand including reasonable attorneys’ fees made by any third party due to or arising out of:

  • Your breach of these Terms of Service or the documents they incorporate by reference.

  • Your violation of any law or the rights of a third party (including intellectual property infringement or defamation).

  • Your misuse of our products in a manner not intended by the manufacturer usage guidelines.

11. Force Majeure

NMV Ventures Private Limited shall not be held liable for any failure to perform its obligations (such as delivery delays or order cancellations) where such failure is a result of events beyond our reasonable control. This includes, but is not limited to:

  • Acts of God (floods, earthquakes, severe weather events).

  • Pandemics, epidemics or state-mandated lockdowns.

  • Strikes, labor disputes or civil unrest affecting our logistics partners.

  • Governmental orders, judicial decrees or failure of public utility services (electricity/internet infrastructure).

In such cases our obligation to fulfill the order will be suspended for the duration of the event and we will make reasonable efforts to fulfill the order as soon as operations normalize.

Certain content, products and services available via our Service may include materials from third-parties (e.g. payment gateways, logistics trackers or social media integrations). Third-party links on this site may direct you to external websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites.

13. Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable by a court of competent jurisdiction such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law.
